Terms of Service

Updated 2026-10-07

This English version is provided for convenience. In case of any discrepancy, the Spanish version prevails.

1. Who we are

QR Branding ("Service", "we") is operated by Juan José Camacho, with registered office at 04005, Almería, Spain and tax identification number 76631231S. Contact: support@qr-branding.com.

Payments are processed by our Merchant of Record (EU-registered payments provider), who invoices, collects sales tax / VAT and issues refunds on our behalf. See the full sub-processor list at /subprocessors.

2. What you get

Access to the QR Branding engine through the web builder and the HTTP API (on this site, API access requires an active Studio pack). Two billing channels:

  • Consumer credit packs (this site): one-time purchases of AI credits and unlimited static QRs. Credits never expire on Starter; Pro and Studio expire 12 months from purchase.
  • Marketplace subscriptions: separate plans sold by RapidAPI under their own terms (linked on /api).

Dynamic QRs. A dynamic QR points to one of our addresses (/q/…) that redirects to the destination you choose, which you can change at any time. Each tier lets you create a number of dynamic QRs (currently: Free, 1 with an account; Starter, 3; Pro, 25; Studio, 150) and view their stats over a period (currently: 30 days on Free and Starter, 6 months on Pro and 12 months on Studio). Dynamic QRs already created keep working and can be edited indefinitely, even if your credits run out or your pack expires; the tier only limits the creation of new QRs and the visible stats period. If an account has more dynamic QRs than its current tier allows, it keeps all existing ones and only loses the ability to create more.

Fair use of dynamic QRs. Redirection is provided subject to fair use. To protect the Service from abuse, we may stop recording in the stats automated or mass scans (for example, the same device scanning repeatedly, or traffic spikes generated by bots) while still redirecting them, and manually review accounts whose monthly scan volume far exceeds the usual. That review never means automatically cutting off a printed code in legitimate use; if we detect abusive use, we will contact you before taking any action, except in the cases described in section 4.

3. Free tier

The Free tier allows unlimited manual static QRs, a monthly allowance of AI generations (currently 5 descriptive + 1 artistic) and, with a registered account, 1 dynamic QR. Free tier output carries a discreet QR Branding watermark which is removed on any paid tier.

4. Acceptable use

You may not use the Service to encode content that is illegal in your jurisdiction or in ours, that infringes third-party rights, that depicts minors in a sexual context, or that deceives users (phishing, malware redirects, fake brand impersonation). We may suspend accounts where abuse is reasonably suspected; in that case we refund the unused credits proportionally, with the consequences described in section 5. If we receive a well-founded report about a dynamic QR's destination (for example, phishing or malware), we may pause it immediately while we review it: anyone who scans it will see a notice instead of the redirect. If the report turns out to be unfounded, we reactivate it.

5. Pricing & refunds

Prices are published at /pricing. We invoice in your local currency where supported; otherwise in USD. Tax is calculated and remitted by our Merchant of Record.

Right of withdrawal. Credits are digital content not supplied on a tangible medium, made available to you as soon as payment completes. Under article 103(m) of the Spanish consolidated General Law for the Protection of Consumers and Users (TRLGDCU) and article 16(m) of Directive 2011/83/EU, a consumer loses the right of withdrawal once performance has begun with their prior express consent and their acknowledgement that they thereby lose that right. Before sending you to payment we collect that consent and acknowledgement through a checkbox that is not ticked by default, without which the purchase cannot be completed, and we confirm it to you on a durable medium in the receipt email.

Voluntary refund guarantee. Notwithstanding the above, you can request a full refund of a pack within 14 days of purchase via the link on your receipt or by emailing support@qr-branding.com, even if you have already used some of its credits: we bear that cost. When an order is refunded, the unused credits of that order are removed from your account (the balance never goes negative), any API access it granted ends, and the affiliate commissions it generated are voided. Partial refunds are not available on request; if we issue a partial refund on our own initiative (for example, in the case described in section 4), the same proportion of that order's unused credits and commissions is removed.

6. Scan guarantee

Every export is validated against ISO/IEC 18004 server-side. If a printed QR generated with strictScannability: true ever fails to scan with standard consumer readers, we regenerate the equivalent QR free of charge. You agree to send us a photo of the failing sample and the original export.

7. AI generations

The AI design feature passes your prompt and optional metadata to a third-party LLM provider chosen at request time. You explicitly opt in when triggering AI generation; the specific provider used per request is logged for cost reconciliation and listed at /subprocessors. On the marketplace BYOK endpoint (POST /api/qr/ai/generate) you supply your own key; on this site and on the marketplace managed endpoint (POST /api/qr/ai/generate-managed) we use our own accounts with the providers listed there. Prompts are not retained beyond the request lifecycle and a 30-day idempotency cache keyed by a SHA-256 of the prompt + parameters.

8. Affiliates

Our affiliate program pays 30% of the paid amount on every referred order, with a 90-day attribution window. Payouts are processed monthly through our Merchant of Record once the affiliate balance crosses USD 25. See /docs/affiliates for the full terms. If a referred order is refunded, its commission is voided in the same proportion; if it had already been paid out, it is deducted from the next payout.

9. Service availability

We target 99.5% monthly availability. We do not guarantee uninterrupted access; planned maintenance is announced 24h in advance where possible. We are not liable for downstream third-party failures (LLM providers, payments providers, payment networks).

10. Intellectual property

QR codes you generate are yours — we claim no rights over the output, the prompts you write or the assets (logos, content) you upload. Engine code, templates, brand assets and the site itself remain our property.

11. Liability

To the extent permitted by applicable law, our total liability for any claim arising from your use of the Service is limited to the amount you paid in the 12 months preceding the claim, and we are not liable for indirect, incidental or consequential damages.

These limitations do not apply, and we are liable as provided by law, in cases of: (a) wilful misconduct or gross negligence, liability for which cannot be waived (article 1102 of the Spanish Civil Code); (b) death or personal injury; and (c) any other case in which the law does not allow liability to be excluded or limited. Nothing in these terms limits or excludes the rights that consumer protection law grants on a mandatory basis, including article 86 of the TRLGDCU.

12. Changes

We may update these terms. Material changes are announced via the email associated with your account at least 30 days in advance. Continued use after the effective date implies acceptance.

13. Governing law

These terms are governed by the laws of Spain. Disputes are subject to the exclusive jurisdiction of the courts of Almería, without prejudice to mandatory consumer protection rules in your country of residence.
